Probation May be Possible
In some felony drug cases, it may not be possible to avoid a conviction. First time offenders however, may be eligible for what is known as 410 probation or for cannabis offenses, 550 probation. In a 410 or 550 probation, the case is put on hold for 24 months. If you successfully comply with the terms of the probation, the case is dismissed at the end of the period and no conviction is entered into your record. The case can even be expunged after a period of time.
If you are eligible for a probation outcome, Timothy J. Fiscella can work with the prosecutor and court to obtain it for you. Once you have completed the probation, he can seek to expunge your record.
